4. Contact form and enquiries
Enquiries sent via the contact form or other stated channels are subject to our Privacy Policy. By submitting an enquiry you confirm that the information you provide is accurate and that we may use it to respond to you. We aim to respond to genuine enquiries in a timely manner. We reserve the right to decline, ignore or block messages that are spam, abusive, fraudulent or outside the scope of our services. We do not guarantee a response to every message.
5. Information about our services
Information on the site about our services (web design, hosting, email management, IT support) is for general information and marketing purposes only. It does not constitute an offer or a binding contract. Specific terms, scope, pricing and deliverables for any work will be agreed separately (e.g. by email or written agreement). Nothing on the site creates a contract between you and us until we have agreed the terms in writing.
6. Intellectual property
Unless otherwise stated, all content on the site (including text, graphics, logos, images, and the design and arrangement of the site) is owned by Shaun Allen or used under licence. You may view and print one copy for your personal, non-commercial use. You must not copy, reproduce, modify, distribute, display or use any content for commercial purposes without our prior written consent. Any unauthorised use may violate intellectual property laws and we may take appropriate action.
7. Limitation of liability (important)
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under applicable law (including the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977)
Subject to the above, we do not accept liability for any loss or damage (whether direct, indirect, consequential or otherwise) arising from your use of the site or reliance on its content, including but not limited to loss of profit, data, goodwill or business opportunity. The site is provided “as is” and we do not warrant that it will be uninterrupted, error-free or free of viruses. If you are a consumer, your statutory rights are not affected by these Terms.
8. Third-party links
The site may contain links to third-party websites. Those links are provided for your information only. We have no control over the content or practices of third-party sites and do not endorse them. We are not responsible for any loss or damage that may arise from your use of third-party sites. You use them at your own risk and should read their terms and policies.
9. Complaints
If you have a complaint about the site or our services, please contact us using the details on our contact page. We will try to resolve your complaint promptly. If you are a consumer and we cannot resolve the matter, you may have the right to use alternative dispute resolution (e.g. an approved ODR platform) or to bring a claim in the courts of England and Wales.
10. Changes to these Terms
We may revise these Terms from time to time. The “Last updated” date at the top will be revised when we do. Please check this page periodically. Your continued use of the site after any change constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the site.
11. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the site, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your country of residence.
