The rules for using this website. They do not replace a written agreement if we later take on a project for you.

These Terms of Service apply to https://www.shaunallen.co.uk. Personal data is handled under the Privacy Policy and GDPR Policy. Cookies are explained in the Cookie Policy.

1. Who we are and how to contact us

The site is operated by Shaun Allen, a sole trader based at 18 Pasture View, Kingswood, Hull, HU7 3AH, United Kingdom. We provide website design, hosting, business email and related digital services. We are not VAT registered.

Contact us using the details on our contact page. If we need to contact you, we will use the email or telephone number you give us.

2. Accepting these terms

By using the site you confirm that you accept these terms and will follow them. If you do not accept them, do not use the site. We recommend you keep a copy for your records.

The site is intended for people in the United Kingdom. We only accept quote enquiries from the UK.

3. Using the site

You may use the site only for lawful purposes. You must not:

  • Break any applicable law or regulation
  • Try to gain unauthorised access to the site, our systems, or other people’s data
  • Send defamatory, abusive, fraudulent or otherwise unlawful material through the form or any other channel
  • Use bots, scrapers or other automated tools to access or interact with the site without our written permission
  • Introduce malware or other harmful code
  • Impersonate another person or misrepresent your connection with a business

We may suspend or withdraw the site, or your access to it, if we reasonably believe you have broken these terms, or for operational or legal reasons. How we protect the site is described in the Security Policy.

4. Enquiries and quotes

Sending the quote form is a request for information, not a contract. By submitting it you confirm the details are accurate and that we may use them to reply, as set out in the Privacy Policy.

We aim to reply to genuine UK enquiries, usually within 24 hours. We may decline, ignore or block messages that are spam, abusive, fraudulent, or outside the work we do. We do not promise a reply to every message.

5. Information about our services

Descriptions of design, hosting, email and SEO on this site are general information. They are not an offer and they do not create a contract. Price, scope, timetable and deliverables are agreed separately in writing (for example by email) before work starts.

Quotes and invoices are issued without VAT. If our VAT registration status changes, we will tell you in writing before any new agreement.

Nothing on the site is professional advice you should rely on without checking it against your own circumstances.

6. Intellectual property

Unless we say otherwise, the content of the site (text, design, graphics, logos and layout) belongs to Shaun Allen or is used under licence, and is protected by the Copyright, Designs and Patents Act 1988 and related rights.

You may view and print one copy for your own personal, non-commercial use. You must not copy, adapt, publish or commercially reuse the content without our written permission. Client work we design for you is dealt with in the project agreement, not these website terms.

7. Liability

Nothing in these terms excludes or limits liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be limited under English law, including the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977

Subject to that, we are not liable for loss arising from your use of the site or reliance on its content, including loss of profit, data, goodwill or opportunity, whether direct or indirect. The site is provided as it stands. We do not warrant that it will always be available, error-free or free of harmful code.

If you are a consumer, your statutory rights are not affected. Most visitors use the site as a business. If you later become a client, the written project terms will set out liability for that work.

Links to other websites (for example the ICO or legislation.gov.uk) are for information. We do not control those sites and do not endorse them. You use them at your own risk and should read their terms and privacy notices.

9. Complaints

If you have a complaint about the site or our services, contact us via the contact page. We will try to resolve it promptly.

If you are a consumer and we cannot resolve it, you may be able to use an approved alternative dispute resolution body, or bring a claim in the courts. Data protection complaints can also be made to the ICO.

10. Changes to these terms

We may update these terms. The date at the top will change when we do. Continued use of the site after a change means you accept the updated terms for later visits. If you do not agree, stop using the site.

11. Governing law and jurisdiction

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in the courts of your home nation.
